Terms of Use
These Terms of Use (hereinafter — the Terms) set out the conditions on which Benzinogram (hereinafter — the Service) is provided: the Benzinogram iOS app, and the Telegram bot @PatchgramBot (hereinafter — the Bot), through which the badge and Benzinogram Premium are sold.
Using the app, the Bot, or any function of the Service means the User accepts these Terms in full.
A User who does not accept them must stop using the Service.
1. General provisions
1.1. Benzinogram is an unofficial client for Telegram, built on Telegram's open source. It is not affiliated with, endorsed by, or connected to Telegram Messenger LLP.
1.2. The Service provides software that accesses the User's own Telegram account. The account, the chats and the media belong to Telegram and remain governed by Telegram's Terms of Service and Privacy Policy.
1.3. The Service does not control Telegram, and does not guarantee that any particular Telegram feature, account or piece of content remains available.
1.4. The Service is not intended for use for purposes contrary to applicable law.
2. Conditions of use
2.1. The User must have the legal capacity to accept these Terms. A User under 18 may use the Service only with the consent of a parent or guardian, who accepts these Terms on their behalf.
2.2. The User decides for themselves whether use of the Service is permissible in their country of residence.
2.3. The Service is used at the User's own initiative. No particular way of using it is imposed.
2.4. A Telegram account is required. Telegram may apply its own rules to accounts that use third-party clients, and those rules are Telegram's to enforce, not the Service's.
3. Obligations of the User
3.1. The User undertakes to use the Service exclusively for lawful purposes.
3.2. It is prohibited to use the Service for:
- unlawful activity of any kind;
- distributing prohibited content;
- interfering with the networks, services or information systems of third parties;
- infringing copyright, related or other rights;
- distributing malicious software;
- attempting unauthorised access to the data or infrastructure of the Service;
- obtaining or reselling paid features by circumventing payment, forging purchase confirmations, or sharing them between accounts.
3.3. The User is solely responsible for the consequences of their use of the Service, including anything they send from their Telegram account through it.
4. Rights of the Service
4.1. The Service may change the app, its features, its architecture and the conditions of access without prior notice.
4.2. The Service may temporarily restrict or terminate a User's access in the event of:
- a breach of these Terms;
- identified technical or operational risk;
- a requirement of applicable law.
4.3. The Service does not read or moderate the content of the User's communications. It never passes through the Service's own servers, and what the Service does store is set out in the privacy policy for the app and the bot privacy policy.
5. Financial terms
5.1. Payment made by the User is payment for access to the functionality of the Service: the badge, sold once and kept permanently, and Benzinogram Premium, a subscription for the period paid for.
5.2. Premium is active on one device at a time. Activating it on a new device disconnects the previous one.
5.3. Purchases made through Apple's App Store are subject to Apple's terms, and refunds for them are requested from Apple. Purchases made through the Bot are handled by the payment provider chosen by the User.
5.4. Payments are final, except where a refund is required by applicable law or is granted at the discretion of the Service. A subscription that has already been used is not refunded pro rata.
5.5. Prices may change. A change never affects a subscription already paid for, or a badge already bought.
6. Limitation of liability
6.1. The Service is provided «as is», without a warranty that it will meet the User's particular expectations.
6.2. The Service is not liable for:
- the actions of the User;
- decisions taken by Telegram in respect of the User's account, including restrictions and blocking;
- changes to Telegram's protocol, API or apps that break part of the Service;
- technical failures outside the Service's control;
- direct or indirect losses.
6.3. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
7. Confidentiality
7.1. The Service takes reasonable organisational and technical measures to protect the User's information.
7.2. What is processed, and when it may be transferred to third parties, is set out in the privacy policy and the bot privacy policy.
8. Force majeure
8.1. The parties are released from liability for failure to perform obligations caused by circumstances beyond their control, including acts of public authorities, technical failures, infrastructure outages and other extraordinary events.

10. Final provisions
10.1. These Terms are a public offer.
10.2. Using the Service means accepting all of their conditions.
10.3. The Service may amend these Terms. The current version is always published on this page, and the date above is the date it last changed.
10.4. The invalidity of individual provisions does not affect the validity of the Terms as a whole.
10.5. Disputes are resolved in the manner established by applicable law.
